If you played electronic craps on the Interblock Organic Dice gaming machine at Isle of Capri's Pompano Park Casino in Pompano Beach, Florida between July 8, 2015 and January 22, 2017, you may qualify for benefits from a class action settlement. 


What is the Lawsuit About? 

Daniel Brna, et al. (the "Plaintiffs") filed a class action lawsuit alleging Isle of Capri Casinos Inc. and Interblock USA, LLC (the "Defendants") violated the Florida Deceptive and Unfair Trade Practices Act, as well as various contractual breaches, because the Interblock Organic Dice machines at Pompano Park casino overcharged a commission on winning "Buy Bets" placed on an electronic craps game.  A "Buy Bet" is a particular kind of craps bet that is placed on a specific point (the numbers 4, 5, 6, 8, 9, or 10) and which pays at or near to true odds.  A Buy Bet wins when the specific point is rolled and the loses when a 7 is rolled.  The Plaintiffs claim that instead of charging a 5% commission on the bet amount–as set forth in the Organic Dice’s rules–the Interblock Organic Dice machines charged a 5% commission on the winnings. 

The Defendants denied the Plaintiffs' allegations of wrongdoing and assert multiple defenses in the lawsuit to the Plaintiffs' claims.  The Court has made no determination about the strengths or weaknesses of either the Plaintiffs' claims or the Defendants' defenses.  Instead, Plaintiffs and Defendants have entered into a Settlement Agreement. 


Who is included? 

According to the Court, you are a member of the Settlement Class if, during the period from July 8, 2015 through January 22, 2017, you: (a) were an Isle of Capri Fan Club member; (b) played craps on an Organic Dice machine at Pompano Park casino in Pompano Beach, Florida; (c) placed a Buy Bet on the Organic Dice machines; and (d) won one or more Buy Bets.


How do I participate in the Settlement?

To request a payment, you needed to submit a Claim Form by January 19, 2018.  If you missed the claim deadline, you no longer have the right to compensation under the settlement.

In order to receive a payment under the Settlement, you must submit a Claim Form online or by mail per the instructions on the Claim Form.
Exclude Yourself

If you choose to be excluded from the Settlement (or "opt out"), you will not be bound by any judgment or other final disposition and you will not receive any payment under the Settlement.  You will retain any claims against the Defendants relating to the matters being resolved in this Settlement.

Write to the Court and counsel about why you don’t like the Settlement.  You can do this only if you don’t exclude yourself. 
Attend the Final Approval Hearing (Passed)

The Court held a hearing on February 13, 2018 at 2:30 p.m. (Eastern Time) to decide whether the Settlement should be approved.  
Do Nothing  If you do nothing, you will remain in the Class and be bound by the terms of the Settlement and you will not receive any benefits under the Settlement.
